Albania Adopts New Patent Law in Line with EU Standards

Albanian office HM&H reports that, in July, the Albanian Parliament adopted Law no. 53/2025 on Patents, Utility Models and Supplementary Protection Certificates, aligning the country’s legislation with key European Union acts, including Directive 98/44, Directive 2004/48 and Regulations 469/2009, 2019/933, 1610/96, among others.

The new law, published in the Official Gazette no. 138 on 1 August 2025, repeals relevant provisions of the existing industrial property framework and will enter into force 15 days after publication. Secondary legislation for its implementation is to be adopted by the Council of Ministers within nine months, while current rules on procedures, fees and authorized IP attorneys will remain in effect until then.

Ongoing infringement and administrative proceedings initiated before the law’s entry into force will continue under the previously applicable rules. This reform marks an important step towards harmonizing Albania’s intellectual property system with EU standards.
